Our Dispute Resolution Services

We offer comprehensive Alternative Dispute Resolution (ADR) services through Arbitration, Mediation, and Conciliation - providing flexible, confidential, and cost-effective solutions tailored to your needs.

Arbitration

Arbitration is a form of Alternative Dispute Resolution (ADR) that resolves disputes outside the courts. An impartial third party, known as the Arbitrator, listens and considers every submission made by the parties.

The disputes between the parties will be decided by one or more arbitrators ("Arbitral Tribunal") which renders the 'Arbitration Award'. An Arbitration decision or award is legally binding on all parties and enforceable in courts.

Advantages of Arbitration:
  • Faster Proceedings: Often faster than litigation in court.
  • Language Flexibility: Parties can choose the language of arbitration proceedings.
  • Confidentiality: Proceedings and awards are kept confidential.
  • Limited Appeals: Very limited avenues for appeal of an arbitral award.
  • Simplified Process: Less complicated with simplified rules of evidence and procedure.
  • Impartial Arbitrators: Chosen by the Federation to ensure fairness.
  • Convenience: Easy to schedule and can be attended remotely.

Mediation

Mediation is another form of alternative dispute resolution (ADR) where a neutral mediator helps parties in a lawsuit solve their dispute before trial through facilitated negotiation.

Unlike arbitration, which is somewhat similar to trial, mediation doesn't involve decision making by the neutral third party. The mediator facilitates communication and helps parties find optimal solutions.

Advantages of Mediation:
  • Confidential Process: Parties are not compelled to disclose sensitive information.
  • Party Control: Decisions are based on parties' comfort rather than strict legal facts.
  • Cost Effective: Much less expensive than court litigation.
  • Future Focused: Encourages parties to move beyond past problems.
  • Fast Resolution: Typically resolves disputes much faster than courts.

Conciliation

Conciliation is an ADR process where a neutral conciliator informally tries to settle disputes by improving communication between parties and exploring potential solutions.

The success depends on the conciliator's ability to clarify issues and bring parties to a settlement agreement. A signed Conciliation Settlement Agreement has the same effect as an arbitral award.

Advantages of Conciliation:
  • Active Participation: Both parties engage and explain their positions.
  • Process Integrity: Less chance for misuse due to formal procedure.
  • Cooperative Approach: Less competitive than court processes.
  • Guidance Not Imposition: Conciliator suggests rather than decides.
  • Confidentiality: Parties control what information is disclosed.
  • Binding Agreements: Settlement agreements have award status.
